Contract Disputes
The best time to agree on the terms of a relationship is right at the beginning. In business this is achieved through a negotiated contract.
However, parties rarely think through every contingency at the inception of a relationship. And at the heart of almost every dispute that walks through my door is a contract - whether written or not - and the belief that the other party has violated the terms of the contract.
Complex Litigation
Most civil (an oxymoron but that is what non-criminal matters are called) disputes do not involve a short-term single situation. Instead they are situations that have developed over a period of time that involve many witnesses and documents. And in these instances a client may need to resolve the situation via complex litigation which involves motion practice and many decisions by a trial court before a final decision is issued.
Strategy
Sometimes the best result is not suing. It might be to break apart the dispute and make changes in your business plan to ensure the dispute never arises again.
Other times the best result will be retaining a public relations firm to change your image.
And other times the right solution will be to use the legal system to fight.
Arbitration
Many times the relationship between the parties is governed by an enforceable contract with an arbitration clause so the parties cannot use the court system to resolve the dispute.
Frequently financial relationships are governed by FINRA.
Other times the relationship will include a provision that requires the party to resolve the dispute via the American Arbitration Association.
Either way we can review the contract together and discuss your options.
Civil Appeals
There are times when a client will not obtain the decision they wanted from mediation, trial or arbitration. In these situations we assess whether you have a basis to appeal the decision to the appropriate court.
Mediation
Frequently a dispute can be resolved without involving a judge. In that event we start intervene as early as possible in the dispute by retaining a neutral third party to assist the parties in crafting the best resolution for them.
